TERMS & CONDITIONS

 Product of Switzerland Organization

Effective date: October 26, 2026
Last updated: October 26, 2026

These Terms and Conditions (“Terms”) govern use of the Product of Switzerland Organization website, applications to its product-origin program, and participation in that program. By using the website or submitting an application, you agree to these Terms.

The Product of Switzerland program recognizes products that meet its Swiss-origin standard: all materials and ingredients must be Swiss in origin, and all manufacturing must take place in Switzerland. Additional program rules may apply to particular product categories and will be provided to applicants.

1. The Organization and the program

The Product of Switzerland Organization (“Organization,” “we,” “us”) operates a private product-origin recognition program. Unless we expressly state otherwise, the Organization is not a Swiss government authority, and its recognition is not a government certification or endorsement.

The program provides a way to identify and promote products that meet the Organization’s stated origin standard. Recognition does not replace any legal requirement, product-safety obligation, food or labeling rule, or other certification that may apply to a product.

Organization legal name: [PRODUCT OF SWITZERLAND]
Registered address: [244, 5TH AVE NY, NY 10001 USA]
Contact email: [contact@productofswitzerland.com]
Website: [www.productofswitzerland.com]

2. Eligibility and Swiss-origin standard

To qualify for the Product of Switzerland label or other program recognition:

  • All materials used in the product must be of Swiss origin.
  • All ingredients in the product must be of Swiss origin.
  • All manufacturing must take place in Switzerland.
  • The applicant must provide complete and accurate information and supporting evidence requested by the Organization.
  • The applicant must comply with applicable laws and any product-category requirements communicated by the Organization.

The applicant is responsible for identifying all materials, ingredients, production steps, subcontractors, and relevant suppliers. A product does not qualify merely because it is designed, owned, packaged, branded, or sold by a Swiss business.

The Organization may request additional information or evidence to assess a product. Submission of an application does not guarantee approval.

3. Applications and verification

Applicants must provide truthful, current, and complete information. Supporting documents may include supplier declarations, invoices, certificates, manufacturing records, ingredient or material lists, photographs, and other evidence relevant to the product.

The Organization may review submitted information, ask follow-up questions, and conduct reasonable verification checks. Applicants must promptly inform the Organization of any change that could affect a product’s eligibility.

The Organization may approve or reject an application based on the program standard and the information available. It may also require a product to be resubmitted for review if its materials, ingredients, suppliers, or manufacturing process change.

Application and renewal fees: [state applicable fees, payment terms, and refund policy before applications open.]

4. Use of the label and other program marks

If a product is approved, the Organization grants the applicant a limited, non-exclusive, non-transferable, and revocable permission to use the approved Product of Switzerland label and related program marks for that approved product, subject to these Terms and any written brand-use guidelines.

The permission:

  • Applies only to the product identified in the approval.
  • May not be transferred, sublicensed, altered, or used to suggest that unapproved products qualify.
  • May not be used in a misleading way or in a way that suggests government approval, endorsement, or a broader certification than the Organization has granted.
  • Requires the applicant to follow the artwork, placement, wording, and digital-use rules supplied by the Organization.
  • Ends when approval expires, is withdrawn, or the applicant no longer meets the program requirements.

The Organization retains ownership of its names, logos, label designs, and other program marks. Approval does not transfer ownership of those marks to the applicant.

5. Maintaining approval

Approval is conditional on the product continuing to meet the Swiss-origin standard and other applicable program requirements. The Organization may request updated documents or conduct further checks to confirm continued eligibility.

Applicants must notify the Organization promptly if a product’s materials, ingredients, suppliers, manufacturing locations, or production methods change. The Organization may require re-review before the changed product continues to use the label.

6. Suspension, withdrawal, and appeals

The Organization may suspend or withdraw approval, or require a label to be removed, if it reasonably believes that:

  • The product no longer meets the program standard.
  • Information supplied by the applicant was materially inaccurate or incomplete.
  • The applicant has misused the label or misrepresented the scope of its approval.
  • The applicant has not provided requested verification information.
  • Continued recognition could create legal, safety, reputational, or consumer-confusion concerns.

Where practical, the Organization will notify the applicant of the reason and give the applicant a reasonable opportunity to respond or correct the issue. The Organization may act immediately when necessary to protect consumers, preserve the program’s integrity, or comply with law.

7. Applicant responsibilities

Applicants and approved participants remain responsible for:

  • The accuracy of their applications, product descriptions, labels, and marketing claims.
  • The safety, quality, composition, manufacture, and sale of their products.
  • Compliance with applicable laws, regulations, and industry requirements.
  • Keeping records that support their Swiss-origin claims.
  • Obtaining rights to any images, text, or other materials they submit.
  • Responding to reasonable requests from the Organization about eligibility or continued approval.

The Organization’s review does not replace a producer’s own legal, regulatory, or quality-control responsibilities.

8. Product listings and submitted materials

If an applicant is approved or applies for a public listing, the Organization may publish the business name, product name, product description, approved origin information, website, and images submitted or authorized for publication.

Applicants confirm that they have the rights and permissions needed to provide submitted photographs, text, logos, and other materials. Applicants grant the Organization permission to use those materials to review the application and, where a listing is approved or authorized, to display and promote the relevant product or program listing.

The permission is limited to administering and promoting the program and may be withdrawn for future use by contacting the Organization. Removal from the Organization’s website may not remove copies already made or shared by others.

9. Website use

You may use the website only for lawful purposes. You must not:

  • Interfere with the website’s operation, security, or availability.
  • Attempt to access accounts, systems, or information without authorization.
  • Submit false, deceptive, unlawful, or infringing content.
  • Use the website or program marks to mislead consumers or misrepresent a product’s origin or approval status.
  • Copy, modify, or commercially exploit website content or program marks without permission.

The Organization may restrict or suspend access where it reasonably believes these Terms have been violated or where needed to protect the website, users, or program.

10. Fees and payment

Any application, review, renewal, membership, or other program fee will be shown to the applicant before the relevant service is requested. The fee amount, currency, due date, taxes, payment methods, and refund conditions will be stated at that time.

Fee schedule and payment terms: Unless the Organization states otherwise in writing, paying a fee does not guarantee approval or continued recognition.

11. Marketplace

The Organization may develop an online marketplace for qualifying Swiss products. Marketplace purchases and sales are not governed by these Terms unless the marketplace specifically incorporates them.

Before the marketplace opens, the Organization will publish separate marketplace terms that identify the seller for each transaction and explain applicable payment, delivery, tax, cancellation, return, refund, complaint, and warranty arrangements. A product’s appearance on the marketplace or use of the Product of Switzerland label does not by itself make the Organization the product’s manufacturer or seller.

12. Privacy

The Organization’s collection and use of personal data are described in its Privacy Policy, available at [insert privacy policy link]. By using the website or applying to the program, you acknowledge that personal data may be handled as described in that policy.

13. Third-party websites and services

The website or a product listing may link to third-party websites or services. The Organization does not control those services and is not responsible for their content, policies, availability, products, or transactions. Your use of a third-party service is governed by that provider’s own terms and policies.

14. Disclaimers and liability

The Organization takes reasonable care when administering the program, but it does not guarantee that every product listed or recognized will meet a particular buyer’s expectations or comply with every legal requirement in every country.

To the extent permitted by applicable law, the Organization is not responsible for indirect or consequential losses arising from use of the website or reliance on a product listing or program recognition. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

15. Changes to the Terms

The Organization may update these Terms to reflect changes to the program, website, or applicable requirements. The current version will be posted on the website with its effective date.

Updated Terms apply to future use and new applications from the effective date. If a change materially affects an existing participant’s rights or obligations, the Organization will provide notice and obtain any acceptance required by law.

16. Governing law and disputes

These Terms are governed by the laws of Switzerland, subject to any mandatory protections that apply under the law governing a particular user or transaction.

Any dispute will be handled by the competent courts at [insert city and canton, Switzerland], subject to mandatory rules on jurisdiction and consumer rights.
